TERMS AND CONDITIONS

Welcome to our website. This site is the property of Local Serve. These terms and conditions provide your use of our website and services provided therein. Throughout these terms and conditions, the terms “we”, “us” and “our” refer to Local Serve whereas, “you”, “your” refers to individual users of our website and collectively called as parties. The word “agreement” used hereunder refers to the terms and conditions of Local Serve. Moreover, the words donating the gender in these terms and conditions include the masculine, feminine and neuter whereas, references in these terms and conditions to the singular words include plural and vice versa.

You acknowledge and agree that these terms and conditions are legally binding agreement between you and us. You are requested to read these terms and conditions carefully and if you do not agree with any of the provision herein provided, you should not access and use our website. If these Terms and conditions of service are considered an offer, acceptance is expressly limited to these Terms and Conditions.

WHEREAS, these terms and conditions WITNESSETH that in consideration of conditions herein contained, it is hereby covenanted, agreed, and declared by and among the parties (as defined herein) as follows:

SECTION 1: ABOUT US

SECTION 2: ORDERS

We, the Online Supermarket Ltd, supply our customers and users of our website, you, a convenient and user-friendly way to find your necessary and favourite products from your local convenience store and have them delivered straight to your door. When ordering, you are making an agreement with The Online Supermarket Ltd but deliveries will be made from local stores that we are partners with as well as 3rd party companies.

SECTION 3: FEE

 3.1 The price of the product(s) that you order from us, will be the price on our site at the point in time that you submit your order for delivery or change your order. For instance, in the event of any change to the price or promotion/offer of a particular product(s) that you ordered, you will not be able to obtain the different price or the promotion/offer of the particular product(s). 

 3.2 As part of the transaction, you will be charged a small service charge for the use of our services. In the event that your order was cancelled, the service charge will also be refunded. 

SECTION 4: RIGHT OF REFUSAL

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. This is also due to the fact that when you order, a receipt goes directly to your local store in which you ordered and thus, they can either accept or reject your order. Despite the majority of orders being accepted, these restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address and/or due to the fact that your local convenience store has run out of the products you ordered and/or the store is unable to complete the order for the time you have ordered. In the event that any of these has occurred, you would be able to pick an alternative product from the local convenience store. Accordingly, if your alternative is cheaper than the product you ordered, we will issue a refund for the difference. If it is more expensive, you will not be charged anything extra. You will be notified of the alternatives on the receipt for your convenience in identifying the alternatives. 

Similarly, we may refuse to supply you with your order if we realise that you are under the influence of alcohol or drugs. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the email and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors. 

SECTION 5: CANCELLATION POLICY

It is not mandatory for the stores to allow you to cancel or change your order. However, the majority of them may allow you to cancel your order up to the point where our delivery couriers have not started heading toward your location for delivery of your order. 

SECTION 6: DELIVERY

Time: In terms of Delivery Time, we are only providing estimates in terms of delivery time. We do not guarantee that the order will be delivered or ready for collection by the quoted time. 

Force Majeure: Correspondingly, we shall, under no circumstances whatsoever, be held responsible or liable for or deemed in breach of its estimated delivery time because of any delay or failure in the performance of the delivery due to any event or circumstance  the occurrence and the effect of which the party affected thereby is unable to prevent and avoid, including, without limitation, acts of God; pandemics, government regulation, curtailment of transportation facilities, strikes, lock-outs or other industrial actions or trade disputes of whatever nature (whether involving employees of a party or a third party), terrorist attacks, haze, sabotage, riots, civil disturbances, insurrections, national emergencies (whether in fact or law), blockades, acts of war (declared or not), etc. (a “Force Majeure Event”). We shall give you a written notice describing the particulars of the Force Majeure Event that may affect the delay of a product delivery as soon as possible. In other words, we will always strive to deliver the purchased products on time but in the event of unforeseen circumstances such as a Force Majeure Event and due to the outbreak of the COVID-19 pandemic, we will not be held responsible or liable if there is a delay in the delivery because couriers may delay parcels for the reasons aforementioned. 

SECTION 7: COUPONS AND VOUCHERS

You will be able to insert a discount code from your coupon/voucher during your checkout process prior to completing your order. After you have completed your order, you will not be able to use the discount code twice or cancel the utilisation of the discount code.

SECTION 8: CHILDREN UNDER EIGHTEEN (18)

This site is not intended for individuals under the age of 18. If you are under the age of 18, you are strictly not allowed to purchase any products from us. It is also strictly not allowed for anyone to order something from us that has an age restriction and the individual does not meet that age. For example, you are strictly not allowed to order any alcohol-related products, or tobacco-related products unless you are over the age of 18 and meet the legal drinking age of the UK. Hence, you would be advised to have your ID ready, since you may be asked to provide it. If not, you automatically pledge that you are over 18 years old by ordering any product with a legal age restriction.

 

SECTION 9: LIABILITY

            9.1 By ordering products from us, you acknowledge and agree that we shall not be responsible or liable, directly or indirectly, for any allergic reaction or other health related issue or other damage, injury or loss that was caused from purchasing the products of the local convenience stores or anything else associated with the ordering of products, except in the event of negligence by us. You are solely responsible for reading the labels in order to determine whether a product would cause you any allergic reaction or other health-related side effect. 

            9.2 Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).

            9.3 Our maximum liability is the value of your order.
